the Australian Partner visa enables a partner of an Australian national to reside and work in Australia. There are two options for applying for this visa: either through an onshore partner visa application (subclass 820/801) or an offshore partner visa application (subclass 309/100).

Onshore Partner Visa – Subclass 820/801
Onshore partner visa consists of two phases:
Stage 1:
Joint application for both the Temporary Partner Visa (Subclass 820) and the Permanent Partner Visa (Subclass 801).
Stage 2:
Before applying for a permanent Partner visa (subclass 801), you must first receive approval for a temporary Partner visa (subclass 820). To be eligible, you must meet certain criteria, such as being the spouse or de facto partner of:
- An Australian citizen
- An eligible New Zealand citizen
- An Australian permanent resident
Once these prerequisites are met, stage 1 of the application can be submitted and the subclass 820 visa must be approved while you are physically present in Australia. For stage 2, it doesn’t matter if you’re inside or outside of Australia when the subclass 801 visa is issued.
Advantages
If you opt for the onshore partner visa, you’ll be eligible for Medicare coverage while your application is under review. Typically, stage 1 processing times for this visa are about 21 months. During this time, you will be issued a Bridging visa A (BVA), which allows you to work and study full-time once your previous visa expires. You can also apply for a Bridging visa B (BVB) which will allow you to travel outside of Australia and return.
Offshore Partner Visa – Subclass 309/100
Offshore partner visa also consists of two phases:
Stage 1:
Joint application for both the Temporary Partner Visa (Subclass 309) and the Permanent Partner Visa (Subclass 100).
Stage 2:
Submitted 2 years after the first stage to prove that the relationship is still active, as indicated in a Relationship Declaration.
To apply for the Permanent Partner Visa (Subclass 100), you must first obtain the Temporary Partner Visa (Subclass 309). The initial eligibility requirements are the same as those for an Onshore Partner Visa, and you must be one of the following:
- An Australian citizen
- An eligible New Zealand citizen, or
- A permanent resident of Australia
The first stage of the application must be submitted while you are outside of Australia, and the Subclass 309 visa must also be approved while you are outside of Australia. This is the primary difference in the application process compared to the Onshore Partner Visa. Additionally, you can apply for an Offshore Partner Visa based on an “intended” marriage if you are already married when your application is approved. You may be inside or outside of Australia when you submit stage 2 of the application and receive the Subclass 100 visa.
Advantages
Even after submitting an application for an Offshore Partner Visa, you may still travel using a temporary visa, such as a Visitor Visa, while your application is being processed. One of the benefits of the Offshore Partner Visa is that you may experience faster processing times for stage 1, which is typically around 13 months for a decision. The drawback of this option is that you might need to live apart from your partner for at least a year. However, if there are no other options for entering Australia, the Offshore Partner Visa may be the best choice.
Upon approval of this visa, you will enjoy various benefits, including access to Medicare, the ability to work and study full-time, unlimited travel to and from Australia, and free English language lessons.
What’s the difference between the Onshore and Offshore visa application process?
- Onshore and Offshore partner visa application processes differ mainly in terms of the visa issued while the application is being processed and the processing time.
- The relationship requirements and cost of applying for both visas are the same.
- If applying for Subclass 820 visa in Australia, a Bridging Visa will be issued which allow you to stay in Australia, work and enrol in Medicare.
- On the other hand, if applying for a Subclass 309 Partner Visa from abroad, no Bridging Visa will be given and you must be outside of Australia when the visa is approved.
- The processing time for an Onshore application (Subclass 820) is 18 months, which is 5 months longer than the processing time for an offshore application (Subclass 309).
- Although the processing time for an Onshore visa is longer, it allows the applicant to live, work and access Medicare for five months.
